Nick McGrath is an associate in the Omaha, Nebraska, office of Jackson Lewis P.C. He focuses his practice on representing management in all aspects of labor and employment litigation.

Nick advocates for employers in federal and state courts and before several administrative agencies at the federal, state, and local level. He has successfully defended employers facing claims of discrimination, harassment, retaliation, wrongful termination, and unfair labor practices. Nick also understands the importance of safeguarding an employer’s proprietary information through the drafting and aggressive enforcement of non-compete, non-solicitation, and non-disclosure agreements. To that end, Nick represents employers in cases involving unfair competition and the disclosure or use of confidential information.

The Department of Justice Criminal Division has clarified its policy on the Department’s assessment of a company’s claim that it cannot afford to pay a criminal fine in a memorandum issued on October 8, 2019.  Criminal Division department head Brian Benczkowski had previewed the memorandum during a speech in September.
